Guaranteed Issue Rights (GIR) are specific situations where insurance companies are legally required to sell you a Medigap policy.
When you have a GIR:
- The company must sell you a plan.
- The company cannot charge you more because of past or present health problems.
- The company cannot make you wait for coverage to start (no pre-existing condition waiting periods).
Essentially, for a brief window of time, your health history is erased from the equation.
The Most Common Triggers for GIR
Not every change in your life triggers these rights. In Florida, and specifically for those I help in the Daytona Beach area, these are the most common scenarios:
- Losing Employer Group Coverage: If you have health coverage through an employer (including retiree or union coverage) and that coverage is ending, you have a right to buy a Medigap plan. This applies whether the plan is primary or secondary to Medicare.
- Your Medicare Advantage Plan Leaves the Market: If your plan stops giving service in your area (common in some rural parts of Florida) or you move out of the plan’s service area, you get a GIR.
- The "Trial Right" Period: If you joined a Medicare Advantage plan when you first became eligible for Medicare at 65, and you decide within the first year that you don't like it, you can switch to a Medigap plan without health questions.
- Losing a Medigap Policy Through No Fault of Your Own: If your Medigap company goes bankrupt or you lose coverage because the company misled you, you are protected.
The 63-Day Clock: Timing Is Everything
The most critical piece of the "Guaranteed Issue" puzzle is the timeline. For most of these situations, you have exactly 63 days from the date your coverage ends to apply for a Medigap plan.
If you are in Volusia County and you miss this window by even one day, the "Guaranteed Issue" protection vanishes. You are then back to "medical underwriting," where a company can look at your history of high blood pressure, cancer treatments, or surgeries and decide you are too much of a risk to insure.
I have seen clients wait until day 70 because they were busy moving or dealing with retirement paperwork, only to find out they were now locked out of the plans they wanted.

Which Plans Can You Get With Guaranteed Issue?
This is a point of confusion for many. You don't necessarily get to pick any plan on the market. The law specifies which plans are protected under GIR.
If you were eligible for Medicare before January 1, 2020, you generally have the right to buy Medigap Plans A, B, C, F, K, or L.
If you became eligible for Medicare on or after January 1, 2020, you generally have the right to buy Medigap Plans A, B, D, G, K, or L.
Plan G has become the "gold standard" for many of my clients in Daytona Beach because Plan F is no longer available to new enrollees. Under GIR, you can secure a Plan G without a single health question, provided you act within that 63-day window after losing your group coverage.
Common Guaranteed Issue Mistakes in Florida
I see these three mistakes more than anything else:
- Thinking COBRA protects you forever: Many people think that while they are on COBRA, they can switch to Medigap at any time. This is dangerous. While losing employer coverage triggers a GIR, voluntarily dropping COBRA later might not. It is almost always better to move straight from employer coverage to Medigap.
- Assuming Plan N is included: In many states, Plan N (which is very popular due to lower premiums) is not a Guaranteed Issue plan. If you want Plan N and you have health issues, you might still have to go through underwriting, even if you are losing employer coverage.
- Missing the "Trial Right" window: If you try a Medicare Advantage plan, you have exactly 12 months to change your mind and get a Medigap plan without questions. If you wait until month 13, you've missed your chance.
